Asobi Master® is operated through Hokkaido International Adventure Masters Co., Ltd. (北海道国際アドベンチャーマスターズ株式会社), Company Registration No. 4500-01-014772, a registered Japanese company, at 5-1-3 Nishi-machi, Higashikawa-cho, Kamikawa-gun, Hokkaido 071-1425, Japan. This page sets out the privacy commitments, terms of service, and statutory commerce disclosures that stand behind that framework:

Legal — our company registration, the Specified Commercial Transactions Act disclosure below, and unrestricted work authorization under Japanese immigration law. The Company is not a licensed travel agency and does not sell package travel; where a project's scope requires travel agency services, it works with licensed partners.

Legit — professional credentials (AAI Professional Level 1, WMAI Instructor), general liability and guest accident insurance in force, a founding role in JOIGA (Japan Outdoor Instructors & Guides Association), and program standards including 1:4 guide ratios and Wilderness EMT‑led programs.

Local — based and registered in Higashikawa, Hokkaido, operating across Asahidake, Asahikawa, and Hokkaido waterways and coasts.

Privacy Policy

Hokkaido International Adventure Masters Co., Ltd., operating as “Asobi Master®” (“we,” “us,” or “the Company”), handles personal information collected in connection with our guiding services, instruction, certification courses, and equipment rental (together, the “Services”) in accordance with this policy and Japan's Act on the Protection of Personal Information.

1. Information We Collect

  • Contact information such as name, address, phone number, and email address

  • Date of birth and emergency contact details (emergency contacts are people whose details you provide to us; please make sure you have their permission)

  • Health information, medical history, and physical limitations needed to run programs safely. This is sensitive personal information under Japanese law: we collect it only with your consent, given in the Liability Waiver, and use it solely for safety-related purposes

  • Payment information (including information collected via our payment processor, Wise, or bank-transfer records)

  • Certification course records and completion/certification data

  • Inquiry content and booking history, including information we receive from a travel agency, booking platform, or referral partner through which you booked

  • Website usage data (cookies, access logs, etc.)

  • For equipment rental: identity document details (retained only until the equipment is returned and any security hold is released), the last four digits of the card on file, and CCTV images of the equipment pickup and return area

2. Purposes of Use

  • Responding to inquiries, managing bookings, and delivering the Services

  • Safety-related decisions (e.g., confirming health status and suitability)

  • Payment processing

  • Registering and reporting course completions to certifying bodies

  • Processing insurance coverage and claims

  • Meeting our legal, tax, and corporate record-keeping obligations, and reporting to government authorities as required by law

  • Statistical analysis for service improvement (in de-identified form only)

3. Disclosure to Third Parties

We do not sell personal information and do not share it for marketing purposes. We disclose personal information to third parties only in the following cases:

  • Payment providers, to the extent needed to process payment: Stripe, Inc.; Wise; and GMO Aozora Net Bank

  • Our insurer or insurance agency (including Mitsui Sumitomo Insurance Co., Ltd.), where needed for accident/injury coverage or a claim

  • Certifying bodies such as, but not limited to, the American Canoe Association (ACA), Paddle Canada, and Wilderness Medical Associates (WMA), for course records

  • Contract guides engaged by the Company to deliver your program, limited to the information needed for safe delivery and bound by confidentiality

  • The travel agency, booking platform, or referral partner through which you booked, to the extent needed to fulfill the booking

  • Where disclosure is required by law

  • Where urgently necessary to protect life, body, or property

4. Transfers Outside Japan

Some of the providers above are located outside Japan, including in the United States (Stripe, Microsoft, ACA), Canada (Paddle Canada), and the United Kingdom/European Union (Wise). By using our Services you consent to these transfers. We transfer information only to providers that maintain data protection measures appropriate to the purpose.

5. How We Store and Protect Information

Personal information is stored on Company-controlled, password-protected and encrypted devices and in Microsoft 365 cloud services under the Company's account. Access is limited to the Representative Director and, where necessary for program delivery, to contract guides bound by confidentiality. Information is transmitted to third parties using encrypted communications or another secure method specified by that third party. The equipment pickup and return area is camera-monitored for security and handover verification; footage is retained only as long as needed for that purpose. If a data breach affects your personal information, we will notify you and the relevant authorities as required by Japanese law.

6. Cookies and Analytics

Our website may use cookies and analytics tools to understand usage and improve our Services.

7. Retention Period

We retain personal information only as long as necessary for the purposes above or as required by law. Accounting, tax, and corporate records are kept for 10 years, as required by Japanese law. Safety records, signed agreements (including Liability Waivers), and incident reports are kept for 20 years, the period within which personal-injury claims may be brought under Japanese law. Information is securely disposed of when no longer required.

8. Your Rights: Access, Correction, and Deletion

You may request disclosure, correction, suspension of use, or deletion of your personal information held by us, and we will respond in accordance with Japanese law. Deletion may be limited where we are required by law to retain the information (for example, accounting and tax records) or where retention is necessary to establish or defend legal claims; in those cases we will explain the basis and delete the remaining information where possible. 9. Changes to This Policy; Language

We may revise this policy to reflect changes in law or in our Services. Revisions take effect once posted to our website. The English text of this policy governs; the Japanese text is a convenience translation.

【Cookie及びアクセス解析】当社ウェブサイトでは、利用状況の把握及びサービス改善のため、Cookie及びアクセス解析ツールを使用する場合があります。

Terms of Service — Standard Terms & Conditions (v5.4, effective 1 October 2026)

These are the Company's Standard Terms & Conditions, incorporated by reference into every booking confirmation, service agreement, rental agreement and invoice. The English text governs; the Japanese text below is a convenience translation.

These Standard Terms & Conditions (“Terms”) govern all bookings, guided programs, tours, courses, expeditions, excursions, and equipment rentals offered by the Company, and are incorporated by reference into every booking confirmation, service agreement, rental agreement, and invoice. By booking, making payment, or taking possession of rental equipment, the Client accepts these Terms.

1. Company & Definitions

“Company,” “we,” and “HIAM KK” mean Hokkaido International Adventure Masters Co., Ltd. (Company Registration No. 4500-01-014772), also trading/operating as “Asobi Master® (アソビマスター®)”, and any lawful successor or assignee. The Asobi Master® mark is used under license from its registered owner. “Client” means the person or organization making a booking; “Participant” means each individual taking part; “Services” means any guided, instructional, educational, recreational, or tourism program; “Rental” means equipment provided under the Company’s Rental Agreement.

2. Order of Precedence

If documents conflict, the order of control is: (1) a signed product or course agreement or written amendment; (2) for courses, the current Training Terms & Conditions; (3) these Terms; (4) website or promotional materials. The Liability Waiver is a separate, required document; nothing in these Terms alters it. Bookings made through third-party platforms or agents are additionally subject to that channel’s payment and refund terms; the Company acts as principal for the experience itself, and promises made by an agent or platform beyond the written booking confirmation do not bind the Company.

3. Booking & Payment — Paid in Full, First Come

Dates are confirmed only upon full payment and, where required, a signed agreement. We receive multiple inquiries for the same dates and resources and cannot hold dates without payment; bookings are confirmed first-come, first-served. A provisional hold lapses 48 hours after invoice if payment and signature are not received. Bank transfer to our GMO Aozora Net Bank account is the default payment method for domestic (Japan) transactions; Wise is the default for international transactions; credit card via our payment processor, Stripe, is used for remaining transactions that require card payment and for security holds (authorizations, not charges) on high-value rental items. Card processing fees are absorbed by the Company; bank-transfer and Wise fees, and any foreign-exchange difference, are borne by the payer. Bank details are provided on the invoice. All prices are stated in Japanese yen, which is the controlling currency; a quote may also show an indicative US dollar amount at the exchange rate on the quote date, but the yen amount governs and payment is settled in yen unless otherwise agreed in writing. All refunds are calculated in Japanese yen. Cash is not accepted in principle. The Client warrants that any payment method used is their own or is used with the holder’s authority, and remains responsible for all amounts due regardless of who pays.

4. Cancellation by Client — Service

Refunds are calculated from the scheduled service date: 61 or more calendar days prior — 75% refunded; 60–31 days — 50% refunded; 30 days or fewer — no refund. No refund applies for late arrival, no-show, or failure to meet participation prerequisites stated in the product agreement, these Terms, or the Liability Waiver (including required equipment standards). Where practical, we may offer rebooking in place of cancellation at our discretion, subject to availability. We are happy to move a booking once, subject to availability, when requested 31 or more calendar days before the scheduled date; refunds after any Client-requested date change are calculated from the original scheduled date. Once a program begins, unused days or portions are not refundable. Cancellation percentages apply per participant and reducing group size cancels that participant’s place on the same schedule. Bookings are personal and non-transferable; where a participant cannot attend, we may instead offer, at our discretion, a credit toward the following season of up to 50% of the amount paid for that place. All cut-offs are calculated in Japan Standard Time. Cancellation percentages are genuine pre-estimates of the Company’s loss from holding dates and resources, not penalties, and apply regardless of the reason for cancellation — including flight disruption, visa or border issues, or illness — except where these Terms expressly provide otherwise; any goodwill exception requires documentary evidence (e.g., a medical certificate or airline cancellation notice). A Service is delivered when our guide or staff is ready at the confirmed time and meeting point; late arrival or non-attendance is not non-delivery.

5. Cancellation by Client — Rentals

Refunds are calculated from the first scheduled rental day: 31 or more calendar days prior — 75% refunded; 30–15 days — 50% refunded; 14 days or fewer — no refund. No-shows are treated as day-of cancellations. Once equipment is checked out, unused days and rest days are not refundable, and early returns earn no refund. Where documented injury or illness prevents use (medical certificate in the renter's name), we may offer a rental credit valid through the following season in place of the standard schedule, at our discretion. Weather and conditions do not create refund rights on equipment-only rentals; go/no-go decisions rest with the Renter under the Rental Agreement. Date changes and group-size reductions follow the same schedule as cancellations.

6. Cancellation by Company; Weather, Conditions & Force Majeure

We may alter, shorten, relocate, or cancel any Service or Rental due to weather, snow or water conditions, safety, operational restrictions, insufficient participants, or causes beyond our control. If we cancel a booking outright, the Client chooses rescheduling or a refund less unrecoverable costs already incurred (e.g., facility deposits, third-party bookings). Where a program runs in modified or shortened form for safety, guide decisions govern and the day is not treated as a cancellation. Safety calls rest finally with the on-site guide or staff. If the Client declines a reasonable modified, relocated, or rescheduled program offered for the same date(s), the booking is treated as a Client cancellation under Clause 4. The Company is not liable for consequential costs such as flights, accommodation, or other travel arrangements. Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, including natural disasters, severe weather, government action, transport disruption, or public health emergencies; where such an event prevents delivery, the Company will reschedule or credit the booking where possible.

7. Refund Mechanics, Payment Disputes & Chargebacks

Refunds are made via the original payment route where possible, net of unrecoverable payment-processor or bank fees and foreign-exchange differences. Bank and card processing times are outside our control and do not alter refund eligibility or constitute default. Payments may be processed by third-party providers (e.g., GMO Aozora Net Bank, Wise, or Stripe); their terms govern payment mechanics only and do not alter these Terms. The Client agrees to raise any billing or refund dispute with the Company first and to follow the process in Clause 20 before initiating a card chargeback or payment reversal. Where services were delivered as agreed, or a refund was correctly calculated under these Terms, initiating a chargeback constitutes a breach of these Terms, and the Company may recover the disputed amount, chargeback and processing fees, and the reasonable costs of responding, and may suspend current or future bookings pending resolution. Booking records, acceptance of these Terms, signed agreements and waivers, and records of delivery may be submitted as evidence in any payment dispute. Nothing in this clause limits rights the Client holds under mandatory law.

8. Participation Requirements

A signed Liability Waiver is required from every Participant before taking part; declining to sign is treated as a Client cancellation under Clause 4. Participants under 18 require parent/guardian consent as set out in the waiver. Clients must describe ability, fitness, and experience honestly; we may adjust, restrict, or decline participation where skill, fitness, equipment, or impairment creates unacceptable risk, without refund in principle. The Liability Waiver is provided at the time of booking for advance review; it is the Client’s responsibility to read it, raise any questions before the service or rental date, and ensure every Participant completes it. We do not send signature reminders. A waiver check is performed before each activity: a Participant without a completed waiver may sign on site after review, or may not take part, and non-participation due to a missing or refused waiver is treated as a Client cancellation under Clause 4. Provision at booking constitutes reasonable opportunity to review. Health information is disclosed in the Liability Waiver, is collected with the Participant’s consent, and is used only for safety.

9. Minors & Safeguarding

Participants under 18 must be booked by a parent or legal guardian, who signs the Liability Waiver on their behalf; each product agreement states whether a parent or guardian must participate or be present. Helmets are required for minors on all active programs. The Company maintains a written safeguarding policy for programs involving participants under 18 or vulnerable adults. Staff and contract guides working with minors complete child-safeguarding training and a criminal-record check under Japan’s child-safety framework before delivery. Unobserved one-to-one contact between staff and a minor is avoided — a second adult (staff, teacher, or guardian) is present or within sight. Physical contact is limited to safety, instruction, and first aid. Staff photograph minors only under the media consent in the Liability Waiver. Concerns are reported to the group leader or guardian and, where required, to the authorities. For school and institutional groups, the institution’s own safeguarding policy and designated safeguarding lead apply alongside this clause. A copy of the Company’s safeguarding policy is available on request.

10. Equipment & PPE

Custody and use of rented equipment are governed by the Rental Agreement and the checkout record. PPE requirements in the Liability Waiver apply on all programs, including helmets and certified PFDs for water-based activities. Checkout is a joint inspection: equipment is released only after the Renter confirms function and condition, and issues not reported at checkout but found at return are presumed rental-term damage under the Rental Agreement.

11. Transport

Local transport is incidental to guiding and provided at no separate charge, consistent with the MLIT Guidelines on transport not requiring permission or registration under the Road Transportation Act (国自旅第359号, 1 March 2024). Nothing in these Terms creates a transportation service for hire; purely intercity/airport segments are provided by licensed carriers.

12. InsuranceThe Company maintains general liability insurance and a domestic travel accident insurance policy for guests. The guest accident policy applies to all high-adventure activities and all water programs and covers, within its limits, death and disability, hospitalization, outpatient treatment, personal liability, and rescue and rescuer expenses. A certificate of currency is available on request. This coverage is a Japan-held backstop and does not replace, and is not a substitute for, the participant’s own travel and rescue insurance. Contract guides engaged by the Company carry their own liability insurance. Travel and medical insurance covering the booked activities is strongly recommended and is required where stated on a product sheet. Uninsured costs of injury or damage a Participant suffers or causes are the Client’s responsibility.

13. Assumption of Risk & Limitation of Liability

Most Services are outdoor activities conducted in natural environments and carry inherent risk; every Participant signs the Liability Waiver before taking part. The guide’s decisions on safety matters are final; a Participant removed for safety or conduct reasons is not entitled to a refund. Participation under the influence of alcohol or drugs is prohibited. For claims arising from the Company’s ordinary negligence, the Company’s liability is limited to the amount paid for the Service concerned. Nothing in these Terms excludes or limits liability for gross negligence or willful misconduct, or any liability that cannot be excluded or limited under Japanese law, including the Consumer Contract Act.

14. Photography & Media

The Company may photograph or film programs for safety, training, and record-keeping. Use of a Participant’s image in marketing requires the consent given in the Liability Waiver, which may be withdrawn at any time for future use.

15. Communications & Amendments

Minor operational changes (timing, meeting points, equipment substitutions of similar category) may be confirmed by email or non-disappearing messaging applications (e.g., WhatsApp, LINE, WeChat), provided the record is retained; a clear affirmative reply — “OK,” “agree,” “承諾,” “了解,” or a thumbs-up — constitutes valid acceptance. Disappearing or auto-delete messages are not valid for contractual purposes. Quotes and chat messages are informational until reflected in a booking confirmation or signed agreement. Major terms (pricing, scope, liability, refund tiers) change only by signed amendment or a mutually dated email exchange expressly identified as an amendment.

16. Authority

Each party warrants it has full power and authority to enter into bookings under these Terms. A signatory acting for a company, school, institution, association, or another person without authority personally assumes the resulting obligations. No party may later claim lack of authority or understanding to void an accepted booking.

17. Compliance — Legal・Legit・Local™

To the best of its knowledge and in good faith, the Company maintains the licenses, registrations, insurance, and permits necessary to lawfully conduct outdoor guiding, training, educational services, and equipment rental in Japan, and partners with duly licensed travel agents where travel-arrangement authority is required by law. The Company is not a licensed travel agency and does not sell or arrange package travel; local transport is incidental to guiding. Where a project’s scope requires travel agency services, the Company works with licensed travel agency partners. Laws, regulations, and their interpretation by regulatory agencies may change or vary at any time; the Company monitors requirements and adjusts operations accordingly. Operations follow our Legal・Legit・Local™ philosophy — compliant, ethically run, and grounded in respect for local communities — which may affect scheduling, logistics, or partner selection.

18. Privacy

Personal information is collected and handled as described in the Liability Waiver, the Company’s Privacy Policy (asobi-master.com/legal), and applicable Japanese law, and is used only for operations, safety, payment, identity verification, certification registration where applicable, and legal compliance; retention periods are set out in the Privacy Policy.

19. Indemnity

To the maximum extent permitted by Japanese law, the Client will indemnify, defend, and hold harmless the Company, its officers, employees, contractors, guides, and insurers from losses, claims, damages, or legal expenses arising from the acts, omissions, or breach of the Client or members of the Client’s party. This does not apply to losses caused by the Company’s gross negligence or willful misconduct; where both parties contribute to loss, liability is shared proportionally to each party's fault, as agreed between parties or as determined through the dispute process in Clause 20.

20. Governing Law & Disputes

These Terms are governed by the laws of Japan. The parties will first attempt resolution by good-faith discussion for 10 calendar days (JST) after written notice, then either party may elect confidential, non-binding mediation in Asahikawa, Hokkaido within 60 days. If unresolved, the District Court of Asahikawa is the exclusive court of first instance, unless mandatory law provides otherwise.

21. Versions, Severability & Language

The version of these Terms in effect at the time of booking (shown in the footer) governs that booking. If any provision is held unenforceable, the remainder stays in effect. The English version governs; translations are provided for convenience.

「当社」「HIAM KK」とは、北海道国際アドベンチャーマスターズ株式会社(法人登記番号 4500-01-014772、屋号「Asobi Master®(アソビマスター®)」)及びその適法な承継人・譲受人をいいます。Asobi Master®の商標は登録権利者からの許諾に基づき使用しています。「お客様」とは予約を行う個人又は団体、「参加者」とは参加する各個人、「サービス」とはガイド・講習・教育・レクリエーション・観光に関するプログラム、「レンタル」とは当社のレンタル契約書に基づき提供する装備をいいます。

第2条 優先順位

書類間に矛盾がある場合の優先順位は次のとおりです。(1) 署名済みの商品・コース契約書又は書面による変更合意、(2) コースについては現行の研修規約、(3) 本規約、(4) ウェブサイト又は宣伝資料。危険引受・免責同意書は別途必要な独立の書類であり、本規約はこれを変更しません。第三者のプラットフォーム又は代理店を通じた予約には、当該チャネルの支払・返金条件が追加的に適用されます。体験そのものについては当社が主体として提供し、書面の予約確認書を超えて代理店やプラットフォームが行った約束は当社を拘束しません。

第3条 予約及びお支払い ― 全額前払い・先着順

日程は、全額のお支払い(及び必要な場合は契約書への署名)をもって確定します。同一日程に複数の問い合わせをいただくため、お支払いなしに日程を確保することはできず、予約は先着順で確定します。仮予約は、請求書発行後48時間以内にお支払いと署名がない場合に失効します。国内(日本国内)のお取引については、GMOあおぞらネット銀行口座への銀行振込を既定のお支払い方法とし、海外からのお取引についてはWiseを既定とします。カード決済が必要なその他の取引及び高額レンタル品の保証のためのカード仮押さえ(請求ではなくオーソリ)には、決済代行業者Stripeによるクレジットカード決済を利用します。カード決済手数料は当社が負担し、銀行振込及びWiseの手数料並びに為替差額はお支払い者の負担とします。振込先は請求書に記載します。料金は日本円で表示し、日本円が基準通貨です。見積書に見積日時点の為替レートによる参考米ドル額を併記することがありますが、日本円額が優先し、書面で別途合意しない限り日本円で決済します。返金額も日本円で計算します。現金は原則としてお受けしません。お客様は、使用する支払手段が自己のものであるか、又は名義人の承諾を得て使用するものであることを保証し、誰が支払うかにかかわらず全ての支払債務について責任を負います。

第4条 お客様によるキャンセル ― サービス

返金額はサービス実施予定日を基準に計算します。61日以前:75%返金、60〜31日前:50%返金、30日以内:返金なし。遅刻、無断不参加、又は商品契約書・本規約・危険引受・免責同意書に定める参加条件(必要装備の基準を含む)の不充足による不参加については返金しません。当社の裁量により、可能な場合はキャンセルに代えて再予約をご提案することがあります。実施予定日の31日以前のご依頼であれば、空き状況に応じて予約日程の変更を1回承ります。お客様都合の日程変更後の返金は、当初の実施予定日を基準に計算します。プログラム開始後の未利用日・未利用部分は返金しません。キャンセル率は参加者ごとに適用され、人数の減少は当該参加者の枠のキャンセルとして同じ基準で扱います。予約は本人限りで譲渡できません。参加できない参加者については、当社の裁量により、当該枠の支払額の50%を上限とする次シーズン用クレジットをご提案することがあります。全ての締切は日本標準時で計算します。キャンセル率は、日程・資源の確保に伴う当社の損失の誠実な事前見積であり違約金ではなく、フライトの欠航・遅延、査証・入国の問題、疾病を含め理由の如何を問わず適用されます(本規約に別段の定めがある場合を除く)。善意による例外の適用には証拠書類(診断書、航空会社の欠航通知等)が必要です。当社のガイド又はスタッフが確定した時刻・集合場所で待機した時点でサービスは提供されたものとし、遅刻や不参加は不履行に当たりません。

第5条 お客様によるキャンセル ― レンタル返金額はレンタル初日を基準に計算します。31日以前:75%返金、30〜15日前:50%返金、14日以内:返金なし。無断不参加は当日キャンセルとして扱います。貸出後の未利用日・休息日は返金せず、早期返却による返金もありません。傷病により使用できないことが証明される場合(借主本人名義の診断書)には、当社の裁量により、標準の基準に代えて次シーズンまで有効なレンタルクレジットをご提案することがあります。装備のみのレンタルについて、天候や状況は返金の権利を生じさせず、実施可否の判断はレンタル契約書に基づき借主が行います。日程変更及び人数減少は、キャンセルと同じ基準に従います。

第6条 当社によるキャンセル、天候・状況及び不可抗力

当社は、天候、雪や水の状況、安全、運営上の制約、参加者不足、又は当社の支配を超える事由により、サービス又はレンタルを変更、短縮、場所変更又は中止することがあります。当社が予約を全面的に中止した場合、お客様は、日程変更か、既に発生した回収不能費用(施設の預託金、第三者予約等)を差し引いた返金かを選択できます。安全のためプログラムを変更又は短縮して実施した場合はガイドの判断が優先し、当日は中止として扱いません。安全に関する最終判断は現場のガイド又はスタッフが行います。同一日程について当社が提案した合理的な変更・場所変更・再設定のプログラムをお客様が辞退した場合、当該予約は第4条に基づくお客様都合のキャンセルとして扱います。当社は、航空券、宿泊その他の旅行手配等の派生的費用について責任を負いません。自然災害、悪天候、行政の措置、交通の途絶、公衆衛生上の緊急事態等、合理的な支配を超える事由による履行の遅延又は不履行について、いずれの当事者も責任を負いません。当該事由により提供が不可能となった場合、当社は可能な限り予約の振替又はクレジットで対応します。

第7条 返金の手続、支払紛争及びチャージバック

返金は、可能な限り元の支払経路で行い、回収不能な決済代行業者・銀行手数料及び為替差額を差し引きます。銀行及びカードの処理期間は当社の管理外であり、返金の可否に影響せず、当社の不履行にも当たりません。決済は第三者の事業者(GMOあおぞらネット銀行、Wise、Stripe等)により処理されることがあり、その規約は決済の仕組みにのみ適用され、本規約を変更しません。お客様は、カードのチャージバック又は支払取消を申し立てる前に、まず当社に請求・返金に関する異議を申し出て、第20条の手続に従うことに同意します。合意どおりにサービスが提供された場合、又は本規約に従い返金額が正しく計算された場合にチャージバックを申し立てることは本規約違反となり、当社は係争額、チャージバック及び処理手数料、並びに対応に要した合理的費用を回収し、解決までの間、現在及び将来の予約を停止することがあります。予約記録、本規約への同意、署名済みの契約書及び同意書、並びに提供の記録は、支払紛争において証拠として提出されることがあります。本条は、強行法規に基づきお客様が有する権利を制限しません。

第8条 参加要件

全ての参加者は参加前に危険引受・免責同意書に署名する必要があり、署名を拒否した場合は第4条に基づくお客様都合のキャンセルとして扱います。18歳未満の参加者には、同意書に定める親権者・後見人の同意が必要です。お客様は能力、体力及び経験を正確に申告するものとし、技能、体力、装備又は酩酊等により許容できないリスクが生じる場合、当社は参加を調整、制限又は拒否することがあり、原則として返金しません。危険引受・免責同意書は事前確認のため予約時に提供します。これを読み、サービス又はレンタル日の前に質問し、全ての参加者に記入させることはお客様の責任です。当社は署名の催促を行いません。各アクティビティの前に同意書の確認を行い、未記入の参加者は内容確認のうえ現地で署名するか、参加できません。同意書の未提出・拒否による不参加は第4条に基づくお客様都合のキャンセルとして扱います。予約時の提供をもって、確認の合理的な機会が与えられたものとします。健康に関する情報は危険引受・免責同意書において申告いただき、参加者の同意のもとで取得し、安全管理の目的に限って利用します。

第9条 未成年者及びセーフガーディング

18歳未満の参加者は親権者又は法定後見人がお申込みを行い、本人に代わって危険引受・免責同意書に署名します。親権者・後見人の参加又は同行の要否は各商品契約書に記載します。未成年者は全てのアクティブプログラムでヘルメットの着用を必須とします。当社は、18歳未満の参加者又は脆弱な成人が参加するプログラムについて、書面によるセーフガーディング方針を定めています。未成年者と関わるスタッフ及び契約ガイドは、提供前に子どもの安全確保に関する研修を修了し、日本の子どもの安全に関する法制度に基づく犯罪経歴の確認を受けます。スタッフと未成年者との人目に触れない一対一の接触は避け、第二の成人(スタッフ、教員又は保護者)が同席又は視界内にいるようにします。身体的接触は安全確保、指導及び応急手当に限ります。未成年者の撮影は危険引受・免責同意書における肖像使用の同意に基づく場合に限ります。懸念事項は引率者又は保護者に報告し、必要な場合は関係当局に報告します。学校及び団体のグループについては、当該機関のセーフガーディング方針及び担当責任者が本条と併せて適用されます。当社のセーフガーディング方針は請求に応じて提供します。

第10条 装備及び保護具

レンタル装備の保管及び使用は、レンタル契約書及びチェックアウト記録に従います。危険引受・免責同意書に定める保護具の要件(ヘルメット、水上アクティビティにおける認証済みライフジャケットを含む)は全てのプログラムに適用されます。貸出時の点検は共同で行い、借主が機能及び状態を確認した後にのみ装備を引き渡します。貸出時に報告されず返却時に判明した不具合は、レンタル契約書に基づきレンタル期間中の損傷と推定します。

第11条 送迎

地域内の送迎はガイドに付随するものとして無料で提供し、道路運送法上の許可・登録を要しない運送に関する国土交通省ガイドライン(国自旅第359号、2024年3月1日)に沿って行います。本規約は有償の運送サービスを創設するものではなく、都市間・空港間のみの区間は許可を受けた運送事業者が提供します。

第12条 保険

当社は賠償責任保険及びお客様向けの国内旅行傷害保険に加入しています。傷害保険は全てのハイアドベンチャー活動及び全ての水上プログラムに適用され、保険金額の範囲内で、死亡・後遺障害、入院、通院、個人賠償責任、並びに救援者費用を補償します。保険証明書は請求に応じて提示します。本保険は当社が日本国内で付保する補完的なものであり、参加者ご自身の旅行・レスキュー保険に代わるものではありません。契約ガイドは自らの賠償責任保険を付保します。予約したアクティビティを対象とする旅行・医療保険への加入を強く推奨し、商品説明に明記する場合は必須とします。参加者が被り又は生じさせた傷害や損害のうち保険でカバーされない費用は、お客様の負担です。

第13条 危険の引受及び責任の制限

本サービスの多くは自然環境下で行うアウトドア活動であり、固有の危険を伴います。全ての参加者は参加前に危険引受・免責同意書に署名します。ガイドの安全に関する判断は最終的なものとし、安全上又は行為上の理由で参加を中止された参加者に返金はありません。飲酒又は薬物の影響下での参加は禁止します。当社の通常の過失に起因する請求について、当社の責任は当該サービスについてお支払いいただいた金額を上限とします。本規約は、故意又は重大な過失による責任、及び消費者契約法その他の日本法により免除又は制限できない責任を、免除又は制限するものではありません。

第14条 写真及び映像

当社は、安全管理、研修及び記録のためにプログラムを撮影することがあります。参加者の肖像をマーケティングに利用する場合は、危険引受・免責同意書における同意が必要であり、当該同意は将来の利用について随時撤回することができます。

第15条 連絡及び変更

軽微な運営上の変更(時刻、集合場所、同種装備への差替え)は、記録が保持されることを条件に、電子メール又は消去されないメッセージアプリ(WhatsApp、LINE、WeChat等)で確認することができ、「OK」「同意」「承諾」「了解」又はサムズアップ等の明確な肯定的返信は有効な承諾となります。消去型・自動削除型のメッセージは契約上有効ではありません。見積書及びチャットのメッセージは、予約確認書又は署名済み契約書に反映されるまでは参考情報です。主要条件(料金、範囲、責任、返金率)は、署名済みの変更合意、又は変更であることを明示した相互に日付を付した電子メールのやり取りによってのみ変更できます。

第16条 権限

各当事者は、本規約に基づき予約を行う完全な権限を有することを保証します。会社、学校、機関、団体又は他人のために権限なく署名した者は、その結果生じる義務を自ら負います。いずれの当事者も、後日、権限又は理解の欠如を理由に承諾済みの予約を無効とすることはできません。

第17条 コンプライアンス ― Legal・Legit・Local™当社は、知る限りにおいて誠実に、日本国内でアウトドアガイディング、研修、教育サービス及び装備レンタルを適法に行うために必要な許認可、登録、保険及び許可を維持し、法律上旅行手配の権限が必要な場合には登録を受けた旅行代理店と連携します。当社は旅行業の登録を有しておらず、パッケージ旅行商品の販売・手配は行いません。地域内の送迎はガイドに付随するものです。プロジェクトの範囲上旅行業サービスが必要な場合は、登録済みの旅行代理店パートナーと連携します。法令及び規制当局の解釈は随時変更されうるため、当社は要件を継続的に確認し、運営を調整します。当社の運営は、法令を遵守し、倫理的に運営され、地域社会への敬意に根ざしたLegal・Legit・Local™の理念に従い、これが日程、物流又はパートナーの選定に影響することがあります。

第18条 個人情報

個人情報は、危険引受・免責同意書、当社のプライバシーポリシー(asobi-master.com/legal)及び適用される日本法に従って取得・取り扱い、運営、安全管理、決済、本人確認、資格認定団体への登録(該当する場合)及び法令遵守の目的にのみ利用します。保有期間はプライバシーポリシーに定めます。

第19条 補償

日本法の許す最大限の範囲で、お客様は、お客様又はお客様の同行者の作為、不作為又は違反に起因する損失、請求、損害又は法的費用について、当社、その役員、従業員、契約者、ガイド及び保険者を補償し、防御し、免責します。当社の重大な過失又は故意による損失には適用しません。双方の過失が損失に寄与した場合、責任は当事者間の合意又は第20条の紛争解決手続を通じて定める各当事者の過失割合に応じて分担します。

第20条 準拠法及び紛争解決

本規約は日本法に準拠します。当事者は、書面による通知後10暦日(日本標準時)の間、まず誠実な協議による解決を試み、その後いずれの当事者も60日以内に北海道旭川市における秘密保持付きの非拘束的調停を選択することができます。解決に至らない場合、強行法規に別段の定めがない限り、旭川地方裁判所を第一審の専属的合意管轄裁判所とします。

第21条 版、分離可能性及び言語

予約時点で有効な本規約の版(フッターに表示)が当該予約に適用されます。いずれかの条項が無効とされた場合でも、その他の条項は引き続き有効です。英語版が正本であり、翻訳は参考のために提供されます。

Price | As stated on each program page or in an individual written quote, in Japanese yen (tax included). Any US dollar figure shown on a quote is indicative only, at the exchange rate on the quote date; the yen amount governs. Quotes are valid for 30 days from the date of issue.

Charges Other Than the Listed Price | Card processing fees are absorbed by the Company. Bank-transfer and Wise fees, and any foreign-exchange difference, are borne by the payer. Any additional costs (e.g., travel to a location outside the standard meeting point) are stated in the written quote in advance.

Courses (Instruction and Certification) | A seat is reserved by a non-refundable deposit credited to the course fee; the balance is due by the date on the invoice; a course runs with a minimum of three confirmed candidates. Candidate cancellation: 45+ days before the first course day, 75% of the balance refunded; 44–21 days, 50%; 20 days or fewer, none; the deposit is not refunded. If the Company cancels a course, the candidate chooses rescheduling with the deposit rolled forward, or a refund of all monies paid including the deposit less documented unrecoverable third-party costs. Equipment Rental — Additional Charges | Security holds (pre-authorizations, not charges) of ¥30,000 for items valued over ¥50,000 and ¥100,000 for items valued over ¥300,000, released after return and inspection; late-return, damage or loss, and rush-request (within 48 hours) fees as set out in the Rental Agreement.

Accepted Payment Methods | Bank transfer to GMO Aozora Net Bank (default for domestic/Japan transactions); Wise (default for international transactions); credit card via Stripe, Inc. (remaining transactions, and security holds on high-value rental equipment).

Timing of Payment | Bookings are generally confirmed only upon payment in full. Larger engagements may be governed by a separate written contract.

Timing of Delivery / Provision of Service | The program date or rental period agreed at the time of booking.

Cancellations and Refunds | Guiding/instruction: 75% refund 61+ days before, 50% 60–31 days before, no refund within 30 days. Equipment rental: 75% refund 31+ days before, 50% 30–15 days before, no refund within 14 days. Cancellations due to weather or other unavoidable circumstances are rescheduled or credited to the following season.

Withdrawal / Cancellation of an Order | Governed by the cancellation policy above. Except as required under the Act on Specified Commercial Transactions, refunds are not available once a Service has been provided, given its nature.

Quantity Limits | Subject to each program's capacity or available inventory.

装備レンタルの追加料金 | 保証仮押さえ(請求ではなくオーソリ):評価額5万円超の品目は3万円、30万円超の品目は10万円(返却・点検後に解除)。返却遅延、損傷・紛失、及び急ぎの依頼(48時間以内)に係る料金はレンタル契約書の定めによります。

お支払い方法 | 国内取引(既定):GMOあおぞらネット銀行への銀行振込。海外取引(既定):Wise。その他の取引及び高額レンタル品の保証仮押さえ:決済代行業者Stripe, Inc.によるクレジットカード決済。
